WLBZ2.com Finish Line Challenge OFFICIAL CONTEST RULES
- NO PURCHASE NECESSARY TO ENTER OR TO WIN. A PURCHASE WILL NOT INCREASE
YOUR ODDS OF WINNING. ALL FEDERAL, STATE, LOCAL AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED. - Eligibility. The Finish Line Challenge (the “Contest”) is
open to Maine residents, 18 years or older at the time of entry. Employees of WLBZ 2 and UPICKEM (“Sponsor”) and each of their respective affiliated companies, subsidiaries, advertising or promotional agencies, and other agents, and the immediate family members of, and any persons domiciled with such employees, are not eligible. - Entry. The Contest begins at 12:01 a.m. (E.S.T.) on
February 27, 2008 and all entries must be received by 11:59 p.m. (E.S.T.) on November 15, 2008 (the “Contest Period”). For each race, players will pick the 10 drivers they think will finish 1st through 10th. Drivers will be awarded Fantasy Points depending on how they finish. 1st place is worth 150, 2nd place is worth 125, 3rd place is worth 100, 4th place is worth 80, 5th place is worth 78, and so on (less 2 points each place). 44th place and beyond are worth 0 points. The total Fantasy Points for all the player's drivers in the race becomes the Team Score. There is an additional 25 point bonus for every driver that comes in the exact order the player picks them to finish.
You total score is the sum of your best 15 races.
If there is a tie for the most points for a race, the tie breaker is handled by first seeing who picked the most drivers in the right order. If there is still a tie, the computer will see who picked the highest place correct. If there is still a tie, the computer will randomly select a winner from the players that are tied.
If there are ties for overall score, the computer will select the player with the most race points for the most recent race. If there is a tie, the computer will continue comparing race points for previous races until a winner is selected. If the players are tied for all the races, the computer will randomly select a winner from the players that are tied.
Points are awarded to drivers, not cars. If a player picks a driver who qualified for race and a new driver took his/her place before the start of the race, the player must pick the new driver. Players will not receive points even though the new driver may be racing the previous driver's car. And, if the new driver is not in the list of drivers that can be picked then no players shall have the ability to pick that driver and it will not count for or against anyone.
Weekly winners are based on the race finish order immediately following the race. If the race finish order is adjusted after the race, the weekly winners will remain the same but all players' points will be recomputed for the season total.
All decisions of the judges are final.
Internet Entry (This is the only means of entering contest.): Enter by visiting the Finish Line Challenge official registration page on the WLBZ 2 website www.WLBZ2.com and completing all of the required information and following all instructions. Submit your entry by clicking on the “SEND” button. Your computer must accept cookies, or any successor or similar technology, which may be used for the purpose of entry tracking. By entering, you agree to the terms of these Official Rules and to receive e-mails from Sponsor or those directed by Sponsor. You can opt-out of the receipt of such e-mails by following the directions on the Contest website or in any email received from Sponsor.
One (1) weekly entry per person for each qualified race during the Contest Period is allowed.
WLBZ 2 and UPICKEM will not be responsible for incomplete, lost, late, misdirected or illegible entries or for failure to receive entries due to transmission failures or technical failures of any kind, including, without limitation, malfunctioning of any telephone connection, network, hardware or software, whether originating with sender or Sponsor. In the event of a dispute, all online entries will be deemed to have been submitted by the owner of the email account from which they were sent. For these purposes, an email account holder shall mean the natural person assigned to such email account by the Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with such email account. All entries become the property of Sponsor and none will be returned. Any questions regarding the number of entries submitted or the owner of an email account shall be determined by Sponsor in its sole discretion, and Sponsor reserves the right to disqualify any entries by persons determined to be tampering with or abusing any aspect of the Contest. - Prizes and Odds. Local Prizes (provided by WLBZ 2): One
(1) Local Weekly Prize Winner will be selected based on the most weekly points earned from among all eligible WLBZ2.com entries. One (1) Local Grand Prize Winner will be selected after the final race based on the best overall total score of each player’s best 15 races from among all eligible WLBZ2.com entries. Local Weekly Prize Winners will receive merchandise with an approximate retail value of $10.00. Local Grand Prize Winner will receive four (4) tickets to the NASCAR Nationwide Series race held in 2009 at the NHIS in Louden, N.H. with an approximate retail value of $170.
National Prizes (provided by UPICKEM): One (1) National Weekly Winner will be selected based on the most weekly points earned from all eligible national entries. One (1) National Grand Prize Winner will be selected after the final race based on the best overall total score of each player’s best 15 races from among all eligible national entries. National Weekly Grand Prize Winners will receive an official NASCAR Schedule Watch sponsored by Game Time Shop and an Official NASCAR Fathead sponsored by Fathead.com with a combined approximate retail value of $200. National Grand Prize Winner will receive a trip for two to the Richard Petty Racing Experience which includes a voucher for travel and lodging with a combined approximate retail value of $4,000. - Winner Notification and Acceptance. Local Weekly and Local
Grand Prize Winners will be notified by telephone by WLBZ 2 at the telephone number provided on winner’s entry form on or about 2 days following a race event. Failure to reach winner by phone may result in disqualification of the winner, forfeiture of his/her interest in all prizes, and selection of a substitute winner from among all remaining eligible entries.
National Weekly and National Grand Prize Winners will be notified by email by UPICKEM. If a winner is unreachable after seven (7) days, or if that winner is unavailable for prize fulfillment, an alternative winner will be selected. If UPICKEM or its affiliates cannot reach eligible winner for the prize, that prize will not be awarded.
Both Local and National Weekly and Grand Prize Winners may waive their right to receive prizes. Prizes are nonassignable and nontransferable. No substitutions allowed, except that prizes and individual components of prize packages are subject to availability and Sponsor reserves the right to substitute prizes of equal or greater value. Winners are solely responsible for reporting and payment of any taxes on prizes. Winners will be required to complete an affidavit of eligibility, an IRS form W-9 and a liability and publicity release (except where prohibited by law) which must be returned within ten (10) days of date of postmark. Failure to sign and return the affidavit, the form W-9 or release within ten (10) days, or to comply with any term or condition of these Official Rules, may result in a winner’s disqualification, the forfeiture of his or her interest in the prize, and the award of the prize to an alternate winner. Except where prohibited, participation in the Contest constitutes entrant’s consent to the publication of his or her name, biographical information and likeness in any media for any commercial or promotional purpose, without limitation or further compensation. Prizes not won and claimed by eligible winners in accordance with these Official Rules will not be awarded and will remain the property of Sponsor. For prize winners list (available after November 20, 2008), send a self-addressed, stamped envelope to Sponsor at WLBZ 2, 329 Mt. Hope Ave., Bangor ME 04401, attention Mark Parent. - Participation. By participating, entrants agree to be
bound by these Official Rules and the decisions of the judges. Sponsor reserves the right to disqualify persons found tampering with or otherwise abusing any aspect of this Contest as solely determined by Sponsor. In the event the Contest is compromised by a virus, non-authorized human intervention, tampering or other causes beyond the reasonable control of Sponsor which corrupts or impairs the administration, security, fairness or proper operation of the Contest, Sponsor reserves the right in its sole discretion to suspend, modify or terminate the Contest. Should the Contest be terminated prior to the stated expiration date, Sponsor reserves the right to award prizes based on the entries received before the termination date. - Limitations of Liability. By entering the Contest, entrant
agrees that (1) any and all disputes, claims, and causes of action arising out of or in connection with the Contest, or any prizes awarded, shall be resolved individually without resort to any form of class action, and entrant waives his or her right to a jury trial for such disputes, claims, and causes of action; (2) any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Contest, but in no event attorneys’ fees; and (3) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for actual out-of-pocket expenses. - Construction. All issues and questions concerning the
construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of any contestant and Sponsor, shall be governed by, and construed in accordance with the laws of the State of Maine, without giving effect to any choice of law or conflict of law rules or provisions (whether of Maine, or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than Maine. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. If any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the valid or enforceable provision was not contained therein. - General Release. By entering the Contest, contestants
release WLBZ 2 and UPICKEM, any other promotional sponsors, and each of their respective affiliated companies, directors, officers, employees, representatives, partners and agents from any liability whatsoever for any claims, costs, injuries, losses or damages of any kind arising out of or in connection with the Contest or with the acceptance, possession or use of any prize (including, without limitation, claims, costs, injuries, losses or damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light). - Sponsor. The Finish Line Challenge is sponsored by WLBZ 2
and UPICKEM, whose decisions regarding the selection of winners and all other aspects of the Contest shall be final and binding in all respects. Sponsor will not be responsible for typographical, printing or other inadvertent errors in these Official Rules or in other materials relating to the Contest.
